Mehlia – Mehlia Resident – Mehlia Website
1. Introduction
Mehlia ("we," "our," or "us") operates a suite of digital products designed to simplify property and tenancy management. These Terms and Conditions ("Terms") apply across all three of our platforms:
- Mehlia – The landlord and property manager mobile application, enabling users to manage rental income, expenses, tenant information, documents, and maintenance records.
- Mehlia Resident – The tenant-facing mobile application, enabling residents to view tenancy details, submit maintenance requests, communicate with their landlord, and manage their tenancy information.
- Mehlia Website – Our public-facing landing page and website, used for product information, marketing, and general enquiries.
These Terms govern your access to and use of any of our platforms. Where provisions apply specifically to one platform, this is clearly indicated. Please read these Terms carefully before using any of our platforms.
By creating an account or using any of our platforms, you agree to be legally bound by these Terms. If you do not agree, please discontinue use immediately.
2. Who We Are
Our platforms are owned and operated by Selira Technology Ventures – FZCO, a company registered under the International Free Zone Authority (IFZA), Dubai, United Arab Emirates.
These Terms constitute a binding legal agreement between you and Selira Technology Ventures – FZCO. References to "Mehlia," "we," "our," or "us" throughout these Terms refer to Selira Technology Ventures – FZCO.
3. Eligibility
To use any of our platforms, you must:
- Be at least 18 years of age;
- Have the legal capacity to enter into binding agreements under the laws of your jurisdiction; and
- Use our platforms only for lawful purposes and in compliance with all applicable laws and regulations.
By registering an account, you confirm that you meet these requirements. If you do not, you are not permitted to use our platforms.
4. Description of Services
4.1 Mehlia (Landlord App)
The Mehlia app provides tools for landlords and property managers to:
- Manage property records and associated documents
- Organize tenant information and lease agreements
- Track rental income and expenses
- Log and manage maintenance records
- Communicate with tenants via Mehlia Resident
- Store documents optionally in the cloud
4.2 Mehlia Resident (Tenant App)
The Mehlia Resident app provides tools for tenants to:
- View tenancy details and lease information shared by their landlord
- Submit and track maintenance requests
- Communicate with their landlord via in-app messaging
- Manage their tenancy-related documents and information
4.3 Mehlia Website
The Mehlia website provides general product information, marketing content, and a means for prospective users to submit enquiries or sign up for communications.
Mehlia is a technology platform only. We do not provide legal, financial, accounting, tax, or real estate advisory services. Nothing in our platforms or these Terms constitutes professional advice of any kind, and you should not rely on them as a substitute for qualified professional guidance.
5. Account Registration and Security
All users across the Mehlia app and Mehlia Resident app are responsible for:
- Maintaining the confidentiality of their login credentials;
- All activity that occurs under their account, whether or not authorized by them;
- Ensuring the accuracy, completeness, and lawfulness of all information they upload or submit; and
- Notifying us immediately at legal@mehlia.co if they suspect any unauthorized access to or use of their account.
We reserve the right to suspend, restrict, or permanently terminate accounts where we have reasonable grounds to believe that a violation of these Terms, applicable law, or third-party rights has occurred.
6. Acceptable Use
You agree to use our platforms only for their intended and lawful purposes. In particular, you must not:
- Use any platform in a way that violates applicable local, national, or international laws or regulations;
- Upload, transmit, or store content that is unlawful, defamatory, fraudulent, or that infringes the rights of any third party;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of any of our apps;
- Use any automated means — including bots, scrapers, or crawlers — to access or extract data from our platforms;
- Introduce viruses, malicious code, or other harmful software into our platforms or their infrastructure;
- Attempt to gain unauthorized access to any part of our platforms, their servers, or connected systems;
- Use any platform to harass, intimidate, or unlawfully surveil any tenant, landlord, or third party;
- Sub-license, sell, resell, transfer, or otherwise commercially exploit our platforms without our prior written consent; or
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
We reserve the right to investigate and take appropriate action against any user who breaches this section, including suspension or termination of access and, where appropriate, reporting to relevant authorities.
7. User Content and Optional Document Storage
The Mehlia app provides optional document storage functionality allowing landlord users to upload records related to their properties and tenants. The upload of documents — including government-issued identification documents — is entirely optional and is not required to use the core features of the app.
By uploading any content to our platforms, you represent and warrant that:
- You have a lawful basis to collect, process, and upload the relevant information;
- You have provided all required notices and, where applicable, obtained valid consents from relevant individuals;
- You comply with all applicable data protection, privacy, and landlord-tenant laws in your jurisdiction;
- You are legally permitted to store such information in a cloud-based system; and
- The content you upload does not infringe the intellectual property, privacy, or other rights of any third party.
We do not verify the legality, necessity, accuracy, or completeness of uploaded content. You are solely responsible for all content you upload and its compliance with applicable law.
8. Sensitive Personal Data
Certain documents that landlord users may choose to upload contain highly sensitive personal information, including government-issued identification numbers, passport copies, visa records, or residency permits.
You acknowledge and agree that:
- We do not require or mandate the upload of such documents;
- We do not determine whether storing such documents is legally required or appropriate in your jurisdiction;
- We do not independently assess your compliance with applicable privacy or data protection laws; and
- You assume full legal responsibility for ensuring that your collection, upload, storage, and use of sensitive personal data complies with all applicable laws and regulations.
Where local law imposes heightened obligations in relation to sensitive personal data — including biometric data, health information, or national identification numbers — you are solely responsible for satisfying those obligations.
9. Data Processing and Privacy
Depending on the context in which personal data is processed, we act in one of the following capacities:
- Data Controller – Mehlia App: For personal data relating to landlord and property manager account holders, we determine the purposes and means of processing.
- Data Controller – Mehlia Resident App: For personal data relating to tenant users who actively register and use the Mehlia Resident app, we are the Data Controller for that data.
- Data Controller – Website: For personal data collected through the Mehlia website (e.g. enquiry forms, cookies, analytics), we are the Data Controller.
- Data Processor: For personal data relating to tenants and third parties uploaded into the platform by landlord account holders (e.g. lease documents, payment records), we process that data on behalf of, and under the instructions of, the landlord account holder, who acts as the Data Controller for that data.
Landlord account holders are solely responsible for ensuring they have a valid and lawful basis to upload, store, and process personal data relating to their tenants or other third parties. We do not independently verify the accuracy, legality, or appropriateness of data uploaded by account holders.
Our Privacy Policy, available at www.mehlia.co, sets out in full how we collect, use, store, and protect personal data across all three platforms. The Privacy Policy forms part of these Terms by reference, and we encourage you to read it carefully.
10. Landlord Responsibilities as Data Controllers
Where landlords upload, manage, or share personal data relating to their tenants through the Mehlia platform, they act as independent Data Controllers for that data. As such, landlords are responsible for:
- Ensuring they have a valid lawful basis for processing tenant personal data;
- Informing their tenants that their data may be stored and managed via Mehlia;
- Responding to data subject requests from their tenants regarding data the landlord has uploaded;
- Ensuring that data uploaded is accurate, up to date, and limited to what is necessary; and
- Complying with all applicable data protection laws in their jurisdiction.
We provide the platform infrastructure but do not verify or take responsibility for the lawfulness of data uploaded by landlord users. If a tenant believes their data has been mishandled by their landlord via the platform, they should contact their landlord in the first instance. We will cooperate with valid legal requests where appropriate.
11. No Monitoring Obligation
We are a neutral technology platform and are under no obligation to:
- Monitor or review uploaded documents or other user content;
- Assess the legal compliance of tenant records or other data; or
- Provide regulatory, legal, or compliance advice to users.
We reserve the right, but not the obligation, to review, remove, or disable access to content that we reasonably believe violates these Terms, applicable law, or the rights of third parties, without notice and at our sole discretion.
12. Subscriptions and Payments
The Mehlia landlord app offers optional paid subscriptions. Subscriptions are currently processed exclusively through Apple Inc. via the Apple App Store.
- Payment information is handled entirely by Apple. We do not collect, store, or process any credit card or payment details.
- Subscriptions automatically renew unless cancelled through your Apple App Store account settings at least 24 hours before the end of the current subscription period.
- Refunds, billing disputes, and subscription management are handled by Apple in accordance with their applicable policies and terms.
- We may update subscription pricing with reasonable advance notice. Continued use of the app following a pricing change constitutes acceptance of the new pricing.
We intend to make the Mehlia app available on Android via the Google Play Store in a future release. When Android subscriptions become available, billing and payment processing will be handled by Google LLC subject to their applicable policies. Direct web-based subscription options may also be introduced in due course. These Terms will be updated accordingly when any new payment channels are activated.
For queries about billing, please refer to your App Store account settings or Apple's support resources. Enterprise or custom subscription plans may be subject to separate written agreements — please refer to Section 20 for further detail.
13. Intellectual Property
All intellectual property rights in and to our platforms — including the software, design, architecture, branding, trademarks, logos, and content — are and shall remain the exclusive property of Selira Technology Ventures – FZCO and its licensors.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use our platforms solely for their intended purpose.
You must not copy, modify, distribute, sell, sub-license, reverse engineer, or create derivative works based on any part of our platforms without our prior written consent.
14. Account Termination
14.1 Termination by You
Users of both the Mehlia app and Mehlia Resident app may initiate deletion of their account directly from within the respective app. You may also contact us at legal@mehlia.co to request account closure. Upon deletion, account data will be handled in accordance with our Privacy Policy and applicable law.
14.2 Termination by Us
We reserve the right to suspend or terminate your account and access to our platforms, with or without notice, if we reasonably believe that:
- You have violated these Terms;
- Your account has been used for fraudulent, unlawful, or abusive purposes; or
- Continued access poses a risk to other users, third parties, or the integrity of our platforms.
14.3 Effect of Termination
Upon termination, your license to use the relevant platform will immediately cease. Personal data will be handled in accordance with our data retention policies as set out in the Privacy Policy, unless retention is required by applicable law.
15. Service Availability
We may update, modify, suspend, or discontinue all or any part of our platforms at any time, including for scheduled or emergency maintenance. We will endeavor to provide reasonable advance notice where practicable, but cannot guarantee uninterrupted or error-free availability.
Our platforms are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
16. Third-Party Infrastructure and SDKs
Our platforms rely on third-party cloud infrastructure and service providers to deliver their services, including Amazon Web Services (for file storage) and Google Firebase (for authentication, push notifications, and analytics).
Our apps and backend infrastructure also integrate third-party SDKs to support core functionality. Each third-party processes data only as necessary to provide their respective service and is subject to their own privacy policy. A full list of integrated SDKs and their data practices is set out in our Privacy Policy.
We are not responsible for interruptions, outages, data loss, or service failures caused by third-party providers. We implement commercially reasonable technical and organizational safeguards, but cannot guarantee the uninterrupted or secure operation of third-party systems. We encourage you to review the terms and privacy practices of any third-party services you interact with through our platforms.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Mehlia shall not be liable for:
- Indirect, incidental, special, punitive, or consequential damages of any kind;
- Loss of profits, revenue, goodwill, data, or business opportunities;
- Regulatory fines or penalties imposed on users for non-compliance with applicable law;
- Claims arising from user-uploaded content or the collection, processing, or storage of tenant data or identification documents;
- Disputes between landlords and tenants arising from or related to use of our platforms;
- Service interruptions caused by third-party infrastructure providers; or
- Losses arising from unauthorized access to your account where such access was not caused by our own negligence.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of our platforms shall not exceed the greater of: the total fees paid by you in the twelve (12) months immediately preceding the claim; or USD 1,000 (one thousand United States Dollars).
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
18. Indemnification
You agree to indemnify, defend, and hold harmless Selira Technology Ventures – FZCO and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, fines, penalties, and legal expenses (including reasonable legal fees) arising out of or relating to:
- Your access to or use of any of our platforms;
- Your upload, storage, or processing of tenant data or government-issued identification documents;
- Your violation of applicable laws or regulations, including data protection law;
- Your breach of these Terms; or
- Your infringement of the rights of any third party.
19. Minors
None of our platforms are intended for use by individuals under the age of 18. You must not use our platforms to upload, store, or process personal data relating to individuals under the age of 18, except where expressly required by applicable law (for example, where a minor is named in a formal tenancy agreement) and only to the extent strictly necessary and lawful.
Where you do upload data relating to a minor, you represent and warrant that you have satisfied all heightened legal requirements applicable to the collection and processing of children's personal data in your jurisdiction.
20. Enterprise Agreements
Enterprise customers or users operating under custom subscription plans may be subject to separate written agreements negotiated with Selira Technology Ventures – FZCO. In the event of any conflict between such an agreement and these Terms, the terms of the separate written agreement shall prevail to the extent of the inconsistency.
21. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure arises from events beyond our reasonable control, including acts of God, natural disasters, government actions, internet disruptions, cyber-attacks, or the outage or failure of third-party cloud infrastructure providers.
In the event of a force majeure event, we will take reasonable steps to resume normal service as soon as practicable.
22. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Where changes are material, we will provide notice through:
- In-app notifications within the Mehlia and Mehlia Resident apps;
- Email communication to registered account holders; or
- A notice on the Mehlia website.
We will update the "Effective Date" at the top of these Terms whenever changes are made. Your continued use of any of our platforms following notification of changes constitutes your acceptance of the updated Terms. If you do not agree to any changes, you should discontinue use of the relevant platform.
23. Governing Law and Dispute Resolution
Mehlia is owned and operated by Selira Technology Ventures – FZCO, a company incorporated in the United Arab Emirates, registered under the International Free Zone Authority (IFZA), Dubai, UAE.
These Terms and any disputes arising in connection with them are governed by the laws of the United Arab Emirates, including the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL). Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE, unless otherwise required by mandatory consumer protection or data protection law in your country of residence.
We recognize that users of our platforms may be located in jurisdictions with their own applicable laws. Where such laws apply — including but not limited to the EU General Data Protection Regulation (GDPR), UK GDPR, or the California Consumer Privacy Act (CCPA) — we are committed to meeting the obligations imposed by those frameworks in addition to UAE federal law.
In the event of a dispute, the parties shall first attempt to resolve the matter through good faith negotiation for a period of thirty (30) days following written notice of the dispute. If the dispute cannot be resolved through negotiation, it shall be referred to the competent courts of Dubai, UAE, as set out above.
24. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
25. Entire Agreement
These Terms, together with the Privacy Policy and any applicable enterprise or supplemental agreements, constitute the entire agreement between you and Selira Technology Ventures – FZCO with respect to your use of our platforms. They supersede all prior and contemporaneous agreements, representations, or understandings — whether written or oral — relating to the same subject matter.
26. Waiver
No failure or delay by either party in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy. No single or partial exercise of any right or remedy shall preclude or restrict further exercise of the same or any other right or remedy.
